These Terms and Conditions (“Terms”) govern your access to and use of the Greek On Wheels website, online ordering services, catering services and related products and services.
In these Terms, “Greek On Wheels,” “we,” “us” and “our” refer to Greek On Wheels. “You” and “your” refer to the person accessing the website, placing an order or purchasing our products or services.
1SERVICES COVERED BY THESE TERMS
These Terms apply to:
- The Greek On Wheels website;
- Pickup and delivery orders placed directly with Greek On Wheels;
- Orders placed through our online ordering system;
- Telephone and in-person orders where applicable;
- Catering inquiries, quotes and confirmed catering orders;
- Promotions, discount codes, gift cards and special offers where offered; and
- Orders placed through third-party ordering and delivery platforms.
Some services may also be governed by additional terms presented during checkout, in a catering quote or through a third-party platform. Where additional terms apply to a particular order, those terms form part of your agreement with us.
2MENU INFORMATION AND AVAILABILITY
We make reasonable efforts to ensure that menu descriptions, photographs, prices, ingredients and availability information are accurate. However:
- Menu photographs are for general illustration and presentation may vary;
- Portion appearance may vary due to food preparation;
- Ingredients and recipes may change;
- Menu items may be modified or discontinued without notice;
- Certain items may only be available at participating locations;
- Prices and availability may differ between locations or ordering platforms; and
- An item displayed online may become unavailable before an order is prepared.
If an ordered item is unavailable, we may contact you to offer a substitution, provide a credit or refund for the unavailable item, or cancel the affected portion of the order.
We will not make a substitution that materially changes the item without attempting to obtain your approval where reasonably possible.
3PRICES, FEES AND TAXES
All prices are shown in Canadian dollars unless otherwise stated.
Applicable taxes, delivery charges, service fees, gratuities and other charges will be displayed before an order is submitted where the order is placed directly through our online ordering system.
Prices may vary between:
- Greek On Wheels locations;
- Pickup and delivery orders;
- Direct orders and third-party delivery platforms;
- Regular menu orders and catering orders; and
- Online and in-store promotions.
Third-party ordering platforms independently determine or display certain service charges, delivery charges, promotional discounts and other fees. Prices available through a third-party platform may be different from prices available directly from Greek On Wheels.
We may correct pricing, menu or calculation errors before accepting an order. If an error affects an order that has already been submitted, we may contact you to confirm the corrected price or cancel and refund the affected order.
4PLACING AND ACCEPTING ORDERS
Submitting an order does not guarantee that it has been accepted.
An order is accepted when Greek On Wheels or the applicable ordering platform confirms the order and the selected location begins processing it.
We may decline or cancel an order for reasons including:
- Menu-item unavailability;
- Incorrect pricing or menu information;
- Payment authorization failure;
- Suspected fraud or misuse;
- An address outside the available delivery area;
- Operational limitations;
- Severe weather, power outages or other circumstances outside our reasonable control; or
- Abusive, threatening or unsafe conduct directed toward our employees, contractors or delivery personnel.
If we cancel a prepaid order before providing the affected products or services, we will issue an appropriate refund to the original payment method, subject to processing times imposed by the payment provider or third-party platform.
5CUSTOMER INFORMATION
You are responsible for providing complete and accurate information when placing an order, including:
- Your name;
- Telephone number;
- Email address where requested;
- Pickup location;
- Delivery address;
- Apartment, unit, buzzer or access information;
- Delivery instructions; and
- Any requested order selections or modifications.
Greek On Wheels is not responsible for delays, failed deliveries or additional costs caused by incorrect, incomplete or outdated information supplied by the customer.
You should review your order carefully before submitting it.
6PAYMENTS
Orders may be paid using the payment methods displayed during checkout or accepted by the applicable location or third-party platform.
By submitting payment information, you confirm that:
- You are authorized to use the selected payment method;
- The information you provide is accurate; and
- You authorize the applicable charges, taxes and fees.
Payments may be processed by an independent payment processor. Greek On Wheels does not necessarily receive or retain your complete payment-card information.
A payment authorization or confirmation does not prevent an order from being declined or cancelled where the order cannot reasonably be fulfilled.
7PICKUP ORDERS
Pickup times are estimates and are not guaranteed.
You are responsible for:
- Selecting the correct Greek On Wheels location;
- Arriving at the location identified in the order confirmation;
- Providing the order name or confirmation information; and
- Picking up the order within a reasonable time after it is ready.
Food quality and temperature may be affected if an order is collected late.
Once an order has been prepared and made available for pickup, a refund may not be available solely because the customer arrived late, attended the wrong location or no longer wants the order.
8DELIVERY ORDERS
Delivery times are estimates and may be affected by:
- Order volume;
- Traffic;
- Weather;
- Road conditions;
- Building access;
- Distance;
- Driver availability;
- Third-party delivery-provider operations; and
- Circumstances outside our reasonable control.
You must ensure that someone is available to receive the order and that the delivery location can be accessed safely.
Where contactless delivery is selected or reasonably required, the order may be left at the delivery location specified by the customer. Responsibility for the order transfers to the customer once it has been delivered to the provided address or left according to the customer’s instructions.
Greek On Wheels is not responsible for loss, theft, spoilage or deterioration occurring after a properly completed delivery.
If a delivery cannot be completed because the address is incorrect, the customer cannot be contacted, access is unavailable or the location is unsafe, the order may be returned or disposed of. Refund eligibility will be determined on a case-by-case basis.
9ORDER CHANGES AND CANCELLATIONS
Contact the selected location as soon as possible to request a change or cancellation.
Because food preparation may begin shortly after an order is accepted, we cannot guarantee that an order can be changed or cancelled.
If preparation has not begun, we may approve a cancellation and issue a refund. If food has already been prepared, ingredients have been committed or delivery has been dispatched, we may deny the cancellation or refund request.
Changes made after an order is submitted may result in additional charges or delays.
Nothing in this section limits any cancellation, refund or other right that cannot legally be excluded under applicable consumer-protection legislation.
10REFUNDS, CREDITS AND ORDER PROBLEMS
Refund, replacement and account-credit requests are reviewed on a case-by-case basis.
Potential resolutions may include:
- Replacing an incorrect or missing item;
- Providing a partial refund;
- Providing a full refund;
- Issuing an account or promotional credit; or
- Declining the request where the order was accurately prepared and properly provided.
When reporting a problem, please provide:
- Your name;
- Order number;
- Ordering location or platform;
- Date and approximate time;
- A description of the issue; and
- Photographs where reasonably relevant.
Please report missing, incorrect or damaged items as soon as reasonably possible after receiving the order. Delayed reports may make it difficult to verify and resolve the issue.
Refunds are normally issued to the original payment method. Bank, card-provider and platform processing times are outside our control.
Promotional credits, goodwill credits and complimentary items have no cash value unless otherwise required by law.
We reserve the right to reject refund claims involving suspected fraud, repeated abuse, false information or circumstances that cannot reasonably be verified.
Nothing in these Terms removes any statutory refund or consumer-protection right available to you under applicable law.
11THIRD-PARTY ORDERING AND DELIVERY PLATFORMS
When you order through a third-party platform, your use of that platform is also governed by the platform’s own terms, privacy practices, fees and refund procedures.
The third-party platform may be responsible for:
- Processing payment;
- Assigning or managing delivery drivers;
- Calculating delivery and service fees;
- Providing delivery tracking;
- Issuing platform credits;
- Processing certain cancellations or refunds; and
- Providing customer support relating to the platform.
Greek On Wheels does not control the operation, availability or performance of third-party platforms.
Problems involving food preparation may be reviewed by Greek On Wheels, while problems involving platform charges, driver conduct, delivery tracking or platform-account issues may need to be handled directly by the applicable platform.
A refund or credit issued by a third-party platform is subject to that platform’s policies and systems.
12CATERING INQUIRIES AND ORDERS
Submitting a catering form or requesting a quote does not create a confirmed catering order.
A catering order is confirmed only when Greek On Wheels has:
- Confirmed availability;
- Approved the menu and quantities;
- Confirmed the date, time and location;
- Provided or approved the final price; and
- Received any required deposit or payment.
Catering quotes may include separate requirements relating to:
- Minimum order amounts;
- Deposits;
- Final guest counts;
- Menu selections;
- Delivery and setup charges;
- Equipment or serving supplies;
- Staffing;
- Rental items;
- Payment deadlines; and
- Cancellation or rescheduling deadlines.
The terms shown in an accepted catering quote, invoice or order confirmation take priority over conflicting general provisions in these Terms for that catering order.
Catering guest counts and quantities
The customer is responsible for selecting quantities appropriate for the event. Any serving estimates we provide are general estimates and may vary depending on appetite, serving size, event duration and other food being served.
Changes to guest counts, menu selections or delivery requirements are subject to availability and may change the price.
Catering cancellations and rescheduling
Catering cancellations and rescheduling requests are reviewed according to the terms stated in the applicable quote or confirmation.
Deposits or payments may become non-refundable when ingredients have been ordered, labour has been scheduled, preparation has begun or the agreed cancellation deadline has passed.
If the catering confirmation does not state a cancellation policy, Greek On Wheels will assess the request on a case-by-case basis based on the amount of notice provided and costs already incurred.
Catering delivery
The customer must provide accurate delivery, parking, loading, access and contact information.
Additional charges may apply where delivery requires unusual waiting time, difficult access, paid parking, multiple delivery attempts or changes not disclosed when the quote was prepared.
Unless setup or staffed service is expressly included in the catering confirmation, catering delivery consists of delivering the prepared order and included supplies to the agreed delivery point.
13FOOD ALLERGIES AND DIETARY REQUIREMENTS
Greek On Wheels prepares food in kitchens where multiple ingredients and allergens may be present, including ingredients containing or derived from:
- Milk;
- Wheat and gluten;
- Sesame;
- Eggs;
- Soy;
- Mustard;
- Peanuts;
- Tree nuts;
- Fish;
- Shellfish; and
- Other potential allergens.
Although we may offer menu items described as vegetarian, vegan, gluten-friendly, halal or suitable for certain dietary preferences, shared preparation, storage, cooking and handling areas may be used.
We cannot guarantee that any menu item is completely free from a particular allergen or that cross-contact will never occur.
Customers with an allergy, intolerance, medical dietary restriction or serious sensitivity must contact the applicable Greek On Wheels location before ordering and clearly identify the concern.
Online comments or modification fields should not be relied upon as the only method of communicating a serious allergy.
Ingredient information is provided in good faith but may change due to substitutions, supplier changes or recipe updates. Customers are responsible for deciding whether a product is suitable for their individual needs.
In the event of a severe allergic reaction or medical emergency, contact emergency services immediately.
14SPECIAL INSTRUCTIONS AND MENU MODIFICATIONS
We will make reasonable efforts to follow accepted special instructions, but modifications are subject to:
- Ingredient availability;
- Preparation methods;
- Food-safety requirements;
- Additional charges; and
- Operational feasibility.
A modification request is not guaranteed unless it appears in the accepted order confirmation.
Removing an ingredient does not guarantee that the item will be free from traces of that ingredient or related allergens.
15PROMOTIONS, COUPONS AND SPECIAL OFFERS
Unless the specific offer states otherwise:
- Promotions are available for a limited time;
- Offers may be limited to participating locations;
- Offers cannot be combined;
- Discounts have no cash value;
- Substitutions may cost extra;
- Taxes, delivery charges, service fees and gratuities are not included;
- Offers may be limited to certain ordering channels;
- A promotional code must be entered before checkout;
- Limits may apply per person, household or order; and
- Promotions are subject to product availability.
Greek On Wheels may correct or withdraw a promotion where it contains a genuine error, is being used fraudulently or is affected by circumstances outside our reasonable control.
We may refuse promotional transactions involving duplication, automation, manipulation, resale or other misuse.
16GIFT CARDS
Where Greek On Wheels gift cards are offered, additional terms presented at purchase may apply.
Gift cards:
- Are redeemable only through participating Greek On Wheels locations or channels;
- Cannot be redeemed for cash except where required by law;
- Must be protected by the purchaser or recipient; and
- May not be replaceable if lost, stolen or used without authorization.
A third-party delivery platform may not accept Greek On Wheels gift cards.
17WEBSITE USE
You may use the website only for lawful personal or business-ordering purposes.
You must not:
- Interfere with the website’s security or operation;
- Attempt to access restricted systems or information;
- Introduce malicious code;
- Scrape, copy or extract website information through automated means without permission;
- Impersonate another person;
- Submit fraudulent orders;
- Use stolen or unauthorized payment information;
- Abuse promotions or refund procedures; or
- Use the website in a manner that violates applicable law.
We may restrict access, cancel orders or take other reasonable action where misuse or fraudulent activity is suspected.
18INTELLECTUAL PROPERTY
The Greek On Wheels name, logos, menu content, photographs, graphics, website design, written materials and other brand assets are owned by or licensed to Greek On Wheels and are protected by applicable intellectual-property laws.
You may view and use the website for personal, non-commercial purposes.
You may not reproduce, modify, publish, sell, distribute, imitate or commercially use our protected materials without prior written permission.
19CUSTOMER COMMUNICATIONS AND CONTENT
When you submit feedback, reviews, photographs, suggestions or other content directly to Greek On Wheels, you confirm that:
- You have the right to submit the content;
- The content is not unlawful, defamatory, fraudulent or infringing; and
- The content does not violate another person’s privacy or intellectual-property rights.
You continue to own your content. However, you grant Greek On Wheels a non-exclusive, worldwide, royalty-free licence to use, reproduce and display voluntarily submitted reviews, feedback and photographs for customer service, operational and promotional purposes, subject to applicable privacy law.
This section does not apply to content submitted through an independent review or social-media platform, which is governed by that platform’s terms.
20WEBSITE AVAILABILITY AND EXTERNAL LINKS
We do not guarantee that the website or online ordering system will always be uninterrupted, secure or error-free.
The website may occasionally be unavailable because of maintenance, technical problems, service-provider outages or circumstances outside our control.
Links to third-party websites are provided for convenience. Greek On Wheels does not control and is not responsible for the content, security, availability or privacy practices of third-party websites.
21DISCLAIMER AND LIMITATION OF LIABILITY
Greek On Wheels will provide its products and services with reasonable care and in accordance with applicable law.
To the maximum extent permitted by law, Greek On Wheels will not be liable for indirect, incidental, special, exemplary or consequential losses arising from use of the website or an order, including loss caused by:
- Website interruptions;
- Third-party platform failures;
- Inaccurate customer information;
- Delivery delays outside our reasonable control;
- Failure to follow storage or reheating instructions;
- Loss or deterioration after a completed delivery or pickup; or
- Unauthorized access resulting from a customer’s failure to protect their device or account.
Where Greek On Wheels is found liable in connection with a particular order, our liability will, to the maximum extent permitted by law, be limited to the direct and reasonably foreseeable loss associated with that order.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or rights and remedies that cannot be waived under consumer-protection legislation.
22INDEMNIFICATION FOR WEBSITE MISUSE
To the extent permitted by law, you agree to compensate Greek On Wheels for reasonable losses, liabilities and expenses resulting directly from your fraudulent, unlawful or intentional misuse of the website, ordering system, promotions or intellectual property.
This provision does not apply to ordinary consumer complaints or the good-faith exercise of legal rights.
23PRIVACY
Our collection, use and disclosure of personal information are governed by our Privacy Policy.
By using our website or placing an order, you acknowledge that information may be provided to service providers involved in processing and fulfilling your order, including:
- Payment processors;
- Online-ordering providers;
- Delivery providers;
- Website and hosting providers;
- Customer-support providers; and
- Marketing or analytics providers where permitted.

24ELECTRONIC COMMUNICATIONS
When you place an order or submit an inquiry, you agree to receive transactional communications reasonably necessary to process the request, such as:
- Order confirmations;
- Receipts;

- Catering communications; and
- Customer-service messages.
Marketing communications will be sent only as permitted by applicable law. You may unsubscribe from promotional emails using the unsubscribe link provided in the message.
Unsubscribing from marketing does not prevent us from sending communications required to fulfill an active order or respond to your request.
25EVENTS OUTSIDE OUR REASONABLE CONTROL
Greek On Wheels will not be responsible for delay or failure caused by events outside our reasonable control, including:
- Severe weather;
- Traffic or road closures;
- Power, internet or telecommunications outages;
- Fire, flood or other emergencies;
- Government orders;
- Labour disruptions;
- Supplier shortages;
- Equipment failure;
- Public-health events; or
- Third-party service interruptions.
We will make reasonable efforts to communicate material interruptions and provide an appropriate remedy where an accepted prepaid order cannot be fulfilled.
26CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes in our services, operations or legal obligations.
The updated version will be posted on the website with a revised effective date.
Changes apply prospectively and will not alter the agreed terms of an order already accepted unless the change is required by law or accepted by both parties.
27GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Subject to any consumer right to bring a claim in another jurisdiction, disputes relating to these Terms will be submitted to the courts located in Ontario.
28SEVERABILITY
If a provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
29NO WAIVER
A failure by Greek On Wheels to enforce a provision of these Terms does not waive our right to enforce it later.
30ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any applicable order confirmation, catering quote or platform-specific terms, form the agreement relating to your use of the applicable services.
